Terms of Service

1. Acceptance of terms

By using RecoverKit ("Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms govern both senders (creditors who submit invoice chases) and the Stripe payment recovery product.

2. Description of service

RecoverKit is an automated email reminder service. It sends professionally worded payment reminder emails on behalf of creditors to individuals or businesses who owe them money for services or goods already rendered. RecoverKit is not a licensed debt collection agency and does not provide legal advice.

The communication record provided by RecoverKit is a private log of emails sent through our system. It is not a certified legal document and carries no special legal standing.

3. Acceptable use

You may use RecoverKit only to send payment reminders for genuine unpaid invoices for services or goods you have already provided. By submitting a chase request, you confirm that:

  • The debt is real and the amount is accurate
  • You have a legitimate business or personal relationship with the debtor
  • The email address you provide belongs to the person who owes you money
  • You are the original creditor, not a third-party debt purchaser or collection agency

4. Prohibited uses

You may not use RecoverKit to:

  • Harass, intimidate, or threaten any person
  • Send reminders for debts you did not personally originate (debt buying, collections on behalf of others)
  • Submit false or fabricated invoices
  • Violate any applicable law, including the Fair Debt Collection Practices Act (FDCPA) or equivalent local law
  • Send emails to recipients who have already told you they dispute the debt — contact a lawyer instead
  • Abuse the system (e.g., submitting the same debtor repeatedly after they have reported the emails)

We reserve the right to terminate campaigns that violate these terms immediately and without refund.

5. Debtor rights

Every reminder email contains a link that allows the recipient to stop the sequence immediately. If a debtor reports an email, we will review the campaign and may suspend it. Abuse reports are taken seriously.

6. Payments and refunds

Paid record retention plans are charged as one-time fees at the time of submission. These fees are non-refundable once the email sequence has been activated. If there is a technical failure preventing delivery, contact us at support@tryrecoverkit.com for a case-by-case review.

For Stripe recovery subscriptions: you may cancel at any time. Cancellation takes effect at the end of the current billing period. No prorated refunds are issued.

7. Disclaimer of warranties

The Service is provided "as is" without warranty of any kind. We do not guarantee that reminder emails will result in payment, that all emails will be delivered, or that the communication record will be accepted as evidence in any legal proceeding. Results vary.

8. Limitation of liability

To the maximum extent permitted by law, RecoverKit's total liability for any claim arising from use of the Service is limited to the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater. We are not liable for indirect, incidental, or consequential damages.

9. Governing law

These terms are governed by applicable law. Disputes will be resolved in good faith first; if unresolved, through binding arbitration or the courts of competent jurisdiction. As an individual operator, RecoverKit makes no representations about compliance with the laws of every jurisdiction — you are responsible for ensuring your use of the service complies with local law.

10. Changes to these terms

We may update these terms at any time. Continued use of the Service after changes constitutes acceptance. Material changes will be noted by updating the date above.
