The Problem of False Credit Reporting

Start by obtaining your credit reports from all three major bureaus. Identify every inaccurate item and document the specific errors. Take screenshots or make copies of your credit reports showing the errors, as they may be corrected or changed during the dispute process.
File disputes with each credit bureau that is reporting the false information. Include a clear description of each error, why it is inaccurate, and copies of supporting documentation. Send your disputes via certified mail with return receipt requested to create a paper trail.
Follow up on your disputes. The credit bureau has 30 days to investigate and must send you the results in writing. If the dispute is resolved in your favor, request a free copy of your updated credit report to confirm that the corrections have been made.
Legal Remedies for False Reporting
If the credit bureau or debt collector fails to correct false information after a proper dispute, you may have a case under the FCRA. The FCRA provides for actual damages, statutory damages, and attorney fees for willful violations, and actual damages and attorney fees for negligent violations.
